General Conditions of Sales and Use

1. PREAMBLE

The company MON VIN NATURE offers for sale products and services related to wines.

The MON VIN NATURE company operates the Site from which it offers its Customers the possibility of placing an Order on the Site to acquire the wines selected by the MON VIN NATURE company, in a specific quantity.

Access and use of these Services are governed by these General Conditions, of which only the French version is authentic. Visitors, Registrants and Customers have the option of saving and printing them.

2. DEFINITIONS

Within the framework of these general conditions of sale and use, the following terms will have the following meaning:

2.1. “Customer(s)”: refers to all persons, aged at least 18 years, previously holding an account on the MON VIN NATURE site, whether or not placing an Order on the Site, for their personal needs or on behalf of of a third party, under the conditions and terms of these general conditions.

2.2. “Order”: refers to the products found in the basket on the MON VIN NATURE site and according to the terms set out in these general conditions.

2.3. “My account”: designates the account created by the user on the MON VIN NATURE Site and accessible using their personal identifiers and password.

2.4. “Personal Data”: refers to personal data allowing the user to be directly or indirectly identified when creating their Personal Account (e.g. name, first name, email address, postal address, user name, date of birth, etc.).

2.5. “Producer(s)”: designates the producers whose selected wines appear on the MON VIN NATURE website.

2.6. “Product”: designates the bottles of wine selected by the company MON VIN NATURE as well as the accessories marketed on the Site and acquired by the Customer by placing an Order on the Site.

2.7. “Site”: designates the website accessible at the URL address https://www.monvinnature.com

2.8. “User(s)”: any person browsing the Site www.monvinnature.com

3. PURPOSE OF THE GENERAL CONDITIONS

The purpose of these General Conditions is to define the conditions and terms under which the company MON VIN NATURE makes its Site available to Visitors, Registered Members and Customers and offers its Products and Services detailed below.

4. ACCEPTANCE OF THESE GENERAL CONDITIONS

These General Conditions apply to any customer or user of the Site.

Access and use of the Site entails the user or customer's acceptance of these General Conditions. Confirming the placing of an Order on the Site, by clicking on the “validate my order” button, after checking the box “I accept the General Conditions of Sale and Use” constitutes full and complete acceptance of the these General Conditions. If you do not agree with the clauses set out below, you are advised not to use the Site and/or not to place an Order.

The applicable General Conditions are those in force on the day of the visit to the Site and the placing of an Order.

These General Conditions may be subject to modification by the company MON VIN NATURE.

In this case, the company MON VIN NATURE will inform the Customers and the new General Conditions will only apply to Orders placed after the modification, or within the framework of Monthly Term Subscriptions, from the month following the modification.

If you do not agree with the modified General Conditions, you are advised to refrain from continuing to use the services of the Site.

Failing this, the modifications made to the General Conditions will be deemed accepted.

5. SALES AND SERVICES TO INDIVIDUALS AND PROFESSIONALS

The company MON VIN NATURE reserves its Products for professional and/or non-professional consumers within the meaning of the Consumer Code. All Customers therefore undertake to act in this capacity. MON VIN NATURE reserves the right to refuse or cancel any Order from a Customer found to be outside of these categories.

6. ACCESS AND USE OF THE SITE

6.1. The company MON VIN NATURE strives to keep the Site accessible without being held to any obligation to achieve this. Access to the Site may be interrupted for maintenance, updating, or any other technical reason.

6.2. Before placing any Order, the Visitor must create “my account” on the Site and provide the information requested, in particular their Personal Data.

As soon as “my account” is created, the user receives an email with a link to confirm their registration. Only one Account per email address will be allowed.

6.3. The user who becomes a client guarantees the accuracy, sincerity and reliability of the information provided, particularly their Personal Data. The customer provides in particular a single valid and functional email address, which will be a means of communication between him and the MON VIN NATURE company, as well as a valid postal delivery address, his telephone number and his date of birth. It is therefore up to customers to modify any change of contact details at any time and as quickly as possible via their Personal Account accessible on the Website in the “my account” section.

6.4. The company MON VIN NATURE cannot be held responsible for the customer's lack of diligence when subscribing, modifying and updating their Personal Data, and as a result of incorrect contact details, with their consequences on the delivery of Orders. .

6.5. The company MON VIN NATURE may check at any time the conformity of the information provided by the Customer and, where applicable, if this information appears to be erroneous and/or misleading, may request the communication of additional or corrected information. In the event of erroneous or misleading information, the company MON VIN NATURE reserves the right, as of right, to suspend and terminate any contractual relationship with the Customer and to suspend access to “my account”.

6.6. The customer has access to “my account” thanks to a username and password that he creates himself when creating “my account”. The customer is solely responsible for the use of his identification elements, he is required to keep them secret. If they lose their password, they can create another one by clicking on “forgotten password”.

6.7. MON VIN NATURE cannot be held responsible for the loss or theft of these identification elements. Elements may be subject to modification only at the customer's initiative. MON VIN NATURE is not responsible for the disclosure of these elements to third parties, nor for the consequences of disclosure.

7. WINE ORDERS

The company MON VIN NATURE offers Customers the possibility of placing an Order through the Site and purchasing the selected wines, within the limits of available stocks and in compliance with these General Conditions.

The photos as well as the evaluations of the products are given for information purposes only and have no contractual value. A difference in color or presentation of the bottles may result in particular from the quality of the photos or their date.

Any Order will only be taken into account after receipt of full payment from the Customer. Any Order will result in an Order confirmation sent by the company MON VIN NATURE to the email address that the Customer provided when registering on the Site.

When placing an Order, it is up to the Customer to verify that the information relating to the Order complies with their choices (Personal Data, delivery method, possible options, place of delivery and/or invoicing of the products, etc. .).

The company MON VIN NATURE reserves the right to refuse any non-compliant or doubtful Order, as well as any Order from a Customer who has not fully paid a previous Order or with whom any dispute is in progress.

The company MON VIN NATURE also expressly reserves the right to study on a case-by-case basis and to accept or refuse any Order for which delivery must take place outside the EEC, in particular with regard to the specific rules and conditions applicable in the country. concerned, which the Customer expressly acknowledges and accepts.

In the event of refusal of the Order in this context, the company MON VIN NATURE will inform the Customer as soon as possible and will reimburse the amount paid.

8. AVAILABILITY OF PRODUCTS

Product offers are valid as long as they are visible on the Site while stocks last. Out of stock products may be marked “Out of stock”.

In the event of permanent unavailability of one or more Products ordered, MON VIN NATURE undertakes to inform the Customer as soon as possible.

In the event of a temporary shortage, the buyer will be asked to wait until the restocking date which will be specified to them.

The Customer may then, at his choice, request:

- The replacement of the unavailable product(s) with one or more products of equivalent quality and price,

- Obtaining a credit from the company MON VIN NATURE corresponding to the amount of the order,

- Reimbursement of the amount debited from his account, this reimbursement occurring within thirty (30) days from receipt of the reimbursement request.

9. PRICE

The prices indicated are in Euro including tax. If a price were to appear in another currency, this amount would only have a purely indicative value. The transport prices are those indicated during the Order.

The prices of Products ordered via the Site are those indicated on the sheet for each Product. These prices include all taxes and exclude transport costs (shipping costs are indicated separately and added to the order amount). The total price of the Order is that indicated when the Customer validates the Order, before the “second click” of confirmation, in accordance with current regulations.

10. PAYMENT TERMS AND SECURITY

For any Order placed, payment is made in full at the time of the Order, by credit card. Once the Order has been validated and the price debited, an invoice is created by the company MON VIN NATURE and is available on “my account”.

In all cases where the Customer has not paid the invoice by the due date, a fixed compensation amounting to 40 euros will be due for recovery costs. If the recovery costs are higher than this compensation (particularly in the event of sending numerous letters), additional compensation will be due by the Customer.

In order to optimize the security of transactions, any payment made by bank card on the MON VIN NATURE Site is made via the Crédit Agricole online payment system so that the information communicated is protected during its transmission.

11. SHIPPING AND DELIVERY

12. PERSONAL DATA

Customers are informed that the Personal Data requested from them and/or collected by the company MON VIN NATURE on the Site and concerning them are processed in accordance with the Privacy Charter.

13. INTELLECTUAL PROPERTY

13.1. The “MON VIN NATURE” brand is registered with the National Institute of Intellectual Property (INPI) under number 4649325 and the European Union Intellectual Property Office (EUIPO). No use of the “MON VIN NATURE” brands and/or logo can be made without the prior written consent of the company MON VIN NATURE.

13.2. All content, in whole or in part, which appears or is available on the Site (including in particular without this list being exhaustive: data, information, texts, illustrations, logos, brands, infographics, photographs, videos, software and computer programs, databases, etc.), and more generally all or part of the Site itself, are protected under copyright and other intellectual property rights for France and the whole world. Users and/or customers are also prohibited from copying, modifying, altering, translating, reproducing, distributing, selling, publishing, exploiting or distributing said elements in any manner and in any form or medium.

13.3. Access to tasting videos posted online on the Site is exclusively reserved for Customers and/or users, for private and non-commercial viewing. No use of these videos can be made without the prior written consent of the company MON VIN NATURE (contact@monvinnature.com).

13.4. Non-compliance with any of the provisions of this article 14 exposes its author (Users and/or Customers) to prosecution and incurs the criminal and civil liability of its author, in particular on the basis of trademark and copyright.

14. LIABILITY AND FORCE MAJEURE

The MON VIN NATURE company guarantees the Customer proper execution until payment of the order placed by the Customer.

However, the company MON VIN NATURE cannot be responsible for:

- In the event of non-compliance by the Customer with the terms of these conditions;

- For any indirect and/or immaterial damage, including in particular bodily injury suffered as a result of the Order, the use of the Products or even loss of reputation likely to occur during the use of all or part of the Products .

The company MON VIN NATURE cannot be held responsible for any malfunction of any nature whatsoever relating to the computer equipment of the user and/or the client as well as to their Internet access connection, during the access to the Site.

Furthermore, the user is solely responsible for the consequences of any damage suffered due to the use by a third party of his identifiers and password to access his Personal Account, his email address or his code(s). (s) confidential(s), and the communication of any information that it has made accessible.

In this context, the customer guarantees the company MON VIN NATURE against any action, recourse or claim in relation to all of the aforementioned elements and, in particular but without limitation, those which would call into question the use and use which could be makes Products.

15. APPLICABLE LAW – SETTLEMENT OF DISPUTES

15.2. In the event of a dispute likely to arise in connection with these General Conditions, their interpretation and their consequences or with the acts supplementing or modifying them, the parties will always endeavor to find an amicable solution before bringing the matter before the courts. .

15.3. 15.4. In the absence of an amicable resolution, the Customer and/or the company MON VIN NATURE may bring his complaint before the competent French courts.
